Client was accused in two separate misdemeanor complaints of having harassed his former therapist in violation of a civil restraining order. The first case was dismissed after the filing of a demurrer ... alleging a violation of the client's First Amendment right to free speech, as the alleged restraining order violation involved posting a negative review on an online business review site. The second case was dismissed after a careful review of discovery revealed that the restraining order was served less than an hour after client's allegedly harassing conduct toward the therapist.
