Karen was driving west on I30 through Rockwall, TX on her way to work at Lockheed Martin. As she drove, a large cable wire fell across the highway and stopped Karen's truck dead in the middle of the h...ighway, wrapping her truck in wires. Karen tore her rotator cuff in her left shoulder due to the impact and had surgery to repair the tear. Karen's medical bills totalled $35,000. Charter said lighting caused the cable to come down so they were not responsible. The Rockwall jury found otherwise and compensated Karen $114,000.

Antonio Puga was working at the Ben E. Keith (BEK) warehouse wrapping pallets of food products to be shipped out in the morning to customers of BEK. These pallets were routinely stacked 5 to 7 feet hi...gh with all types of food products and restaurant supplies. Often times the employees charged with stacking the pallets would be forced to put heavy items at the top. One of these heavy items, a 54 pound box of Coke syrup, fell and struck Antonio on his back. Antonio suffered a herniated disk. Instead of providing medical care and treatment to Antonio, BEK provided limited care and treatment and then fired Antonio.
The jury found that BEK negligently operated their warehouse and demanded that BEK provide proper medical care and treatment to Antonio so he could obtain surgery to repair his herniated disc.

Mr. Marshburn was driving his 18 wheeler back to the Swift yard at the end of a work day. Mr. Molina, driving for Knight Transportation, was operating his 18 wheeter east on I20 just south of downtown... Dallas heading the same direction as Mr. Marshburn. Mr. Molina pulled an empty trailer travelling in the far right lane of the 4 lane highway. It was raining outside and as a car began to merge onto I20 east, Mr. Molina hit his brakes causing his tractor trailer to jack knife. Mr. Molina's tractor struck Mr. Marshburn's tractor causing Mr. Marshburn's tractor trailer to jack knife and crash into the concrete highway barriers.
Mr. Molina improperly attempted to slow his vehicle in the rain. Interestingly, Mr. Molina's employment with Knight was his first job driving a tractor trailer. In his pre-hire testing with Knight, Mr. Molina failed his driving test twice, including failing to properly slow his tractor trailer in adverse weather. In his third driving test, Mr. Molina passed but still failed the section testing his ability to slow his vehicle in adverse weather.

Mr. Jacob Perea was admitted to Southwest Regional Hospital in Lubbock following heart surgery for rehabilitation. On multiple admission documents and subsequent records the physicians and hospital pe...rsonnel noted Mr. Perea's allergy to ativan. Despite these notations of the allergy throughout Mr. Perea's chart, the hospital nurses gave Mr. Perea two injections of ativan. Mr. Perea was found unresponsive the next morning and subsequently died.
The nurse employed at Southwest Regional who documented the "physician's order" for ativan had previously had his license to practice nursing suspended in Colorado for giving ativan to a patient without physician permission. Mr. Perea's physician and physician's assistant at trial all denied giving the order for Mr. Perea to receive ativan. The Director of Nursing at Southwest Regional knew this nurse had previously had his license suspended for giving ativan to a patient without physician permission and choose to hire the nurse anyway. This nurse now has lost his license to practice nursing here in Texas due to stealing patient medication to get high.
