Mr. Menze represented the Mother in a visitation modification trial. The Mother had been allowed only supervised visitation for several years. The Father began to unilaterally deny the Mother her super ... vised visitation time. Mr. Menze filed an emergency Motion to Modify Visitation on behalf of the Mother. The parties engaged with the services of a guardian ad litem and family therapists leading up to the trial. During the trial, Mr. Menze presented evidence of the Father’s violations of the visitation order without cause and other bad acts. The trial was continued to a second day. After the first day of trial the Father ultimately agreed to a settlement that provided the Mother with unsupervised visitation time that increased month to month to an almost split visitation schedule.

Mr. Menze represented Ms. R in her final divorce and equitable distribution trial. During the trial, the opposing party presented evidence that he had almost no income and was unable to pay child suppo ... rt to Ms. R, who had primary custody of the parties’ children. Mr. Menze presented evidence that showed the opposing party left his prior position just before the parties’ separation and failed to secure work at a similar or greater income level. The court found that the opposing party was voluntarily underemployed and imputed income to the opposing party of over $100,000. The court used this imputed income for a child support determination, and Mr. Menze secured a substantial child support amount for Ms. R.

Represented Mother Against Father Seeking Primary Physical Custody

OUTCOME: Sole Custody Awarded to Mother

Mr. Menze represented the Mother in a 3-day custody and visitation modification trial that was initiated by the Father. The parties shared physical custody of their two minor children and the Father ha ... d decision-making authority with health and education issues. The Father was seeking to have primary physical custody of the children in addition to his decision-making authority. The Father requested the court provide the Mother visitation with the children every other weekend or three weekends each month. Mr. Menze had the eldest child testify at the hearing where the child informed the Judge of her preference to remain with the Mother, and about the child’s success in school and extracurricular activities. During the trial Mr. Menze showed that the Father abused his decision-making authority to a point where he was jeopardizing the education of the eldest child and potentially the mental health of the youngest. The court denied the Father’s Motion to Modify Custody and Visitation and in so doing, ruled that the Mother shall have sole legal custody of the children, reduced the Father’s visitation time to every other weekend, and awarded the Mother her attorney’s fees related to the custody modification case brought by the Father.
