Case Summary: A court-appointed guardian with authority limited to property management contacted me regarding an urgent situation involving an incapacitated individual who required immediate medical i ... ntervention. The individual was homeless, suffering from untreated medical conditions, and lacked anyone with legal authority to make healthcare decisions. Legal Challenge: Because the existing guardian did not have personal needs authority under Article 81 Guardianship, critical medical care could not be authorized. Immediate court intervention was necessary to prevent further harm. Strategy & Action: I promptly prepared and filed an Order to Show Cause seeking emergency relief, requesting the expansion of guardianship powers to include personal needs authority. The application was structured to clearly demonstrate the urgency of the situation and the risk to the individual if relief was delayed. Result: The court granted temporary guardianship authority, allowing for immediate medical decision-making and treatment. Following stabilization, the matter proceeded to a full hearing, where the guardian was ultimately appointed with both personal needs and property management authority. As a result: The individual received necessary medical care; Unsafe living conditions were addressed; The individual was placed into an assisted living facility; and Long-term protection and oversight were established. Takeaway: In emergency guardianship situations, rapid legal action can be critical to protecting vulnerable individuals. This case demonstrates the importance of acting quickly to secure court authority when health and safety are at risk.
