OUTCOME: Reversed and Remanded in favor of the Landlord

Landlord brought action against tenant and tenant's managing member for breach of contract and unjust enrichment, alleging that parties entered into month-to-month lease agreement, and that tenant and ... managing member breached lease agreement by failing to pay full amount of rent and late fees and by damaging premises and failing to pay for damage and cost of collection, and that tenant and managing member were unjustly enriched by failing to pay for use and occupancy of premises or for damages to premises. Tenant and managing member moved for summary judgment. The Superior Court, Judicial District of Stamford-Norwalk, Housing Session at Norwalk, Rodriguez, J., granted motion, and subsequently denied landlord's motion to reargue. Landlord appealed.
