When an executor steals the money . . .
May 18, 2017OUTCOME: The executor was revoked and my client was appointed executor of the estate.
My client believed that the executrix had liquidated accounts that were (1) due to my client because he was a beneficiary and/or (2) accounts of the decedent that should have been deposited into the es ... tate account. At the time that he hired me, he had no documentation supporting his claims but knew something "fishy" was going on. I was able to prove, through cross-examination at a lengthy Hearing, that the executrix was lying about the disposition of funds from an account of which my client should have received 50% but she had also filed an incorrect Inheritance Tax Return, thereby failing at the duties of executrix.
