On December 19, 2014, Plaintiff was operating his motor vehicle on Miller Street in Newark, NJ., at which time there was a vehicle in front of him which stopped short which caused him to quickly apply ... his brakes. He was struck in the rear by the vehicle being operated by Defendant, Roland M. Adams. Plaintiff had sustained a C3-4 posterior disc herniation with accompanying lower back pain that radiated into lower extremities; Plaintiff also suffered lower back pain and decreased spacing at L4-L5. May 16, 2019, Dr. John Cifelli, Plaintiff's neurosurgeon, was deposed via a video de bene esse for use at trial. Plaintiff filed opposition to Defendant, Liberty Mutual Insurance Company’s, Motion seeking to edit the caption of and bar portions of the videotaped De Bene Esse deposition of Plaintiff’s treating neurosurgeon, Dr. John R. Cifelli. Plaintiff prevailed on the motion. July 23, 2019 an Offer of Judgment was sent for $50,000. The case was tried to completion over four days. A high-low agreement was made with $25,000 being the low and $60,000 being the high. The jury having returned a verdict of no cause in this matter, the case resolved for the $25,000 "low" agreement.
