Howell and Young represented the purchasers in a real estate transaction which had spilled over into litigation. At issue was whether a case could proceed against the purchasers due to the presence of ... a mediation clause in the operative purchase agreement. After briefs written by Mr. Howell and argued by Mr. Young, the Court ruled in favor of the purchasers holding that the contractual right to mediate was a condition precedent to litigation which was not fulfilled by the sellers. Thus, the Court dismissed the matter without prejudice.
