OUTCOME: Case Dismissed

Defendant was charged with Assault With a Deadly Weapon, a Class B felony. After a preliminary hearing, the district court found “probable cause” and bound the case over to the Grand Jury. The grand ... jury indicted my client for the felony charge. I immediately submitted a pretrial Motion to Declare Defendant Immune From Prosecution and to Dismiss the Indictment (aka a request for a “stand your ground” hearing). A hearing date was set by the court. On hearing day, and at the time for the hearing, the prosecution suddenly dismissed the felony charge.
