Tim was charged with DUI - Physical Control. His public defender at the time convinced him to enter into a Stipulated Order of Continuance that would lead to a conviction on a lesser charge. I became T ... im's Attorney several years later, when the Prosecuting Attorney moved to terminate the Stipulated Order and convict Tim of DUI for probation violations. Ultimately, the court found Tim had in fact violated his probation and revoked his Stipulated Order of Continuance. The Court then proceeded to bench trial at which I raised the affirmative defense, that my client was safely off the roadway. After reviewing all of the evidence and facts presented by the Prosecuting Attorney, the Court concluded that Tim was in fact safely off the roadway and had no choice but to dismiss the charges against him with prejudice and close the case for good.
