OUTCOME: Sucessful Jury Trial
This was an 11 day jury trial, where I was one of the trial attorneys defending Dennis Magner for two wrongful death claims brought by the families of two young adults who died in a boating accident on ... Coeur d'Alene. This was a media intensive case and there are numerous articles on it. I did not work the criminal action; however Mr. Magner was found not guilty of manslaughter. While over 1 million dollars was pitched for each family, by very talented trial attorneys, the Jury came back with $90,000 per family and found that Mr. Magner, my client had a minor amount of fault in the accident, because the other boat was operating with no lights at night. The case involved maritime law to some extent, rules of the watery road, allegations of intoxication, numerous expert and fact witnesses, and difficult facts legally and emotionally on all sides.
OUTCOME: Defense Verdict for the Client
I was one of two trial attorneys defending a doctor alleged to have caused a very serious neck fracture during the course of treatment. There were numerous witness both expert and fact. The case did no ... t settle and went to a 12 day jury trial. The jury found that my client did not cause the injuries alleged and acted properly as a doctor.
