My client was approached by the NYSP in a parking lot of a local restaurant after hours. While he had been consuming alcohol, he never had any intention of operating or moving his vehicle; he was prep ... ared to walk the short distance to his home. The NYSP did not take any of that into consideration before placing him under arrest. Ultimately, my client did provide a breath sample which registered as .29%; quite high. After remaining firm on our position that no actual operation was present here we were able to resolve the case with limited consequences and fines for the client.
