Our firm represented several medical providers in the above action. This was a declaratory judgment action commenced by the insurance company seeking the Court's declaration that the several providers ... are not entitled to collect no-fault benefits. The matter involved hundreds of thousands of dollars. This specific matter was published by the Courts as we won, and Plaintiff's motion was denied, on a technicality where the insurance company failed to comply with the regulations in their defense of EUO no show- and thus the follow up letter which is to be made within 10 days of the second non-appearance was merely 1 day late but case law and the regulations are very strict with the timelines.
