Conviction for Robbery with a Dangerous Weapon and 25-year Prison Sentence Vacated
N/AOUTCOME: Robbery with a Dangerous Weapon Conviction and 25-year Prison Sentence Vacated
In 2003, Defendant plead guilty to Robbery with a Dangerous Weapon (an 85% crime) while represented by another attorney and received a 25-year prison sentence, which meant he would not be eligible for ... parole until 2024. Defendant's attorney at the time, however, did not tell him that Robbery with a Dangerous Weapon was an 85% crime and instead advised that he could be released from prison in 7 years. Following an unsuccessful appeal, application for post-conviction relief, and petition for writ of habeas corpus, Defendant retained Mr. Chaffin, who got the conviction and 25-year sentence vacated. The State refused to dismiss its case against Defendant so he decided to enter a blind plea instead of taking the case to trial. At the sentencing hearing, Mr. Chaffin was able to get 10 years shaved off the original 25-year sentence, and Defendant was released soon thereafter.
