Plaintiff secured loan by recording a note and deed of trust creating a mortgage against the Defendant's interest only. Plaintiff sued Defendant in District Court for Specific Performance of the Note only and feigned through his counsel "election of remedies of his choosing". Default judgement was entered, order for contempt, divestiture of title and denial of Defendants Motion for relief. Defendant appealed to the North Carolina Court of appeals who delivered is unanimous decision that the Court had no jurisdiction to enter it's three (3) orders and judgments against her and vacated them.
