Workplace accident that occurred on 4/7/2011 where Plaintiff suffered a severe back injury while operating a jet-patcher machine. To repair the damage to Plaintiff's spine, an L3-L4 lumbar fusion was p ... erformed. Despite a light duty recommendation by Plaintiff's occupational therapists, Plaintiff was returned to work full duty at a heavy duty job. Due to Plaintiff's age, experience, lack of education, and low likelihood of successful/meaningful vocational retraining, we were able to show that Plaintiff was unable to be competitive in the job market and, therefore, 100% vocationally disabled. The court agreed.
