Medical Malpractice- Birth Injury
Feb 18, 2016OUTCOME: $30,000,000.00
Our office represented the family of a boy born on 11/5/09 with a non-life threatening, easily correctable condition, called esophageal atresia. The day after his birth, Mark J. Holterman, M.D. perf ... ormed what is typically a routine surgery to repair the condition. Following the procedure Dr. Holterman failed to exercise due care and began an odyssey of 24 experimental procedures on the young boy. These procedures were not authorized by the hospital and not pursuant to clinical trial protocol. The final surgery culminated in an inappropriate, off-label use of an endoclose needle that severed the boy's pulmonary artery, thereby causing profound, irreversible brain injury. The case settled just before jury selection. http://chicago.suntimes.com/news/30-million-settlement-in-malpractice-case-against-surgeon-rush/
