OUTCOME: The Deputy Commissioner found in favor of the Claimant and awarded a 40% industrial disability. The employer appealed. The Court of Appeals found in favor of the Claimant upholding the Deputy's decision in its entirety.

Claimant was a long haul trucker who fell and aggravated his pre-existing low back condition and injured his right shoulder while attempting to repair a part on his truck in rainy wet conditions. In ad ... dition to aggravating his pre-existing spinal condition, the Claimant also developed depression as a result of the pain and problems from his work injury. The employer denied the claim.
