When does probate shine? Clears title to real estate: In probate a Judge’s order can clearly and quickly determine just who owns what. Ends the wrangling: An Executor can be kept in line just by knowing that the Judge can be called in on a few day’s notice. Delays costs & hassles: A trust is often at least as expensive as probate, and you pay, now; in probate your kids pay, later. A trust has you changing titles and deeds and accounts. Probate can be simpler, less costly.

For most folks a dump cake Will works & is what they want. Just dump my stuff on the next generation and let them do what they will. A trust is a wonderfully flexible document providing a whole garden of possibilities: for Age; Budgeting; College; Decrepancy; Enjoying--as well as Knotty families; and Tax savings. TOD—the sealed envelope method: transfers accounts, even land, but is not very flexible, and less easy to change if you lose mental capacity. Choose your best combination.
