Davie police stopped the Defendant and his friend while they were walking around in a gated community at 3AM. The officers claimed they conducted a ‘pat down’ of the Defendant due to concerns for offic ... er safety. Officers then reported that after the pat down, Defendant stated that he had marijuana in his pocket. Pursuant to that alleged statement, officers searched the Defendant and discovered marijuana. Mr. Dobrinsky filed a Motion to Suppress all evidence and statements, arguing that the police illegally detained the Defendant, and then proceeded to illegally search him as well. In this Motion, the credibility of the police officers involved was significantly called into question. Mr. Dobrinsky had his Motion to Suppress set for an evidentiary hearing.
