In many states a fiduciary like a Personal Rep or a guardian may not serve if guilty of a felony crime. Not sure if that is the issue for you,...

Ms Jarnagin is right, cut to the chase and go for guardianship. If she has a lawyer though you will definitely need one and a physicians report, too.
