I wrote the appellate brief for the State of Iowa in a case that would determine whether or not the state had an obligation to offer blood testing of a defendant who stated they were intoxicated by dru ... gs instead of alcohol, even if the state was only interested in pursuing an OWI by alcohol charge. We argued that they did not have an obligation to administer blood testing if they had no interest in pursuing an OWI by drug intoxication charge.
