Gina L. Colaluca Celebrates Victory at the Illinois Supreme Court on Attorney Fee Issue

Gina successfully appealed to the Third District Appellate Court an order requiring a family law attorney to pay the opposing attorney over $40,000.00 in attorney's fees that had been previously paid t ... o and earned by the attorney ordered to pay same. Gina argued her client's position at the Supreme Court of Illinois that attorney's fees which have been earned by and paid to an attorney for past services rendered are not "available" under Section 501(c-1)(3) of the Illinois Marriage and Dissolution of Marriage Act to be disgorged. The Illinois Supreme Court ruled in Gina's client's favor. In its opinion, the Illinois Supreme Court held simply that "fees that have been earned by an attorney are not subject to disgorgement."
