I tried this assault C/A Family violence while I was an Assistant District Attorney in Webb County. The victim had been beaten up by her ex boyfriend. The ex boyfriend contacted his uncle, a Lieutena ... nt at the Laredo Police Department. The Lieutenant contacted the first responding officer and told him that the defendant was his nephew. The responding officer, acting on behalf of his superior, the Lieutenant, did NOT arrest the defendant. At trial both the responding officer and the Lieutenant testified on behalf of the defendant. I did the right thing, and I basically crossed-examined my own witnesses! I impeached both officers and secured a guilty verdict for the victim despite the officers' testimony.
OUTCOME: Guilty 25 years
I tried this case as a Webb County Assistant District Attorney. The defendant walked up behind the victim while the victim was asleep with his pregnant girlfriend. The defendant struck the victim on ... the head with a 2x4 repeatedly. The victim died in San Antonio after he was airlifted. The jury verdict was a guilty. The sentence was 25 years.
