Gina Delfino v. Don Griffo, et al.
Apr 08, 2011OUTCOME: Case Settled for Confidential Amount
This was a dram shop liquor liability act claim against three tavern owners and three pharmaceutical companies, whose representatives hosted a luncheon for members of a doctors office that turned into ... eight hours of drinking. Thereafter, one of the doctors' employees drove her vehicle while intoxicated and crashed into Gina Delfino's car, tragically killing her minor child, Manual Delfino. The trial court dismissed the claims against the pharmaceutical defendants finding no duty. The New Mexico Supreme Court reversed in a published opinion: Delfino v. Griffo, 2011-NMSC-015, 150 NM 97, 257 P.3d 917 (2011).
