Tenant terminated lease one month into the lease term and claimed damages from the landlord in excess of $5,000. Landlord countersued for unpaid rent and damages, plus cost of repairs. At full hearin...g, we secured a judgment for the landlord and were able to negotiate with the former tenant to collect the full payment.

OUTCOME: Client placed in affordable housing, gained PFA against abusive son, and was relieved of responsibility for past due rent.
Client came to Clinic from legal services referral. Was a physically disabled, 60+ woman who had suffered several strokes and was confined to a wheelchair. Client was living with adult son, who had r...ecently been removed from the apartment due to physically attacking Client. After removal, Client discovered son had not been sending rent checks to landlord, and she was faced with eviction and civil suit for unpaid rental amounts. Over the course of two months, I obtained a PFA for Client to prevent son from contacting her, negotiated a settlement with son and landlord which relieved Client of all responsibility for the past due rental amounts, and assisted Client in locating income-contingent senior housing to provide her a stable living situation in a community that could care for her physical needs.

Mother of special needs children denied unemployment after being fired without warning.

OUTCOME: Client awarded unemployment benefits due to Employer not following proper disciplinary procedures.
Client was the mother of three children, two of whom were special needs children. Due to her children's needs, mother was late for work on occasion. Client, who had a sterling work record, attempted ...to resolve issues by asking employer to allow her to work evening shifts on school days. Employer refused. Client was warned verbally about tardiness, and two days later fired summarily when she reported to work late after caring for sick children that morning. During investigation, it was discovered Employer's disciplinary policy required several levels of warning, and Client was only provided with one level of warning. Employer challenged unemployment benefits, but was unable to establish they had followed disciplinary procedures. As a result, Client was awarded her unemployment benefits.

OUTCOME: Mother was appointed full guardian.
Mother of a mentally handicapped adult had cared for him his entire life without assistance from the father. In 2013, Father petitioned for adult to be adjudged incapacitated and to have him appointed... guardian. Mother retained civil clinic through pro bono services, and I was appointed to represent her.
Goal of representation was to gain adjudication of incapacitation and to have mother appointed full guardian of son's person and estate (finances). After court held a hearing and took testimony, Mother was awarded full guardianship of her adult son over Father.

Immigrant Denied Unemployment

OUTCOME: Client was awarded unemployment benefits after Employer could not prove their allegations were true.
Client, a legal immigrant to the United States, was employed by an agricultural produce line. He was "picked on" regularly by one coworker, who escalated matters by shoving
Client after Client asked... him to stop. Client, who does not speak English, was not provided an interpreter by the company to get his side of the story and was summarily terminated from his employment for "fighting." When Client filed for unemployment, Employer contested benefits saying Client's termination was due to a violation of the rules and Client shouldn't receive benefits. Client was referred to the Clinic by legal services provider, and I undertook representation. In a Referee hearing, it was determined that the Employer had no witnesses who had seen the event present to testify, could not confirm they had ever given Client a company handbook with the rules, and could not even state that Client engaged in a fight. Unemployment Referee found against the Employer, and Client was awarded his unemployment benefits.
