OUTCOME: DUI and DOS dismissed; client accepted a plea of reckless driving, Class C Misdemeanor.

My client was charged with DUI and driving on a suspended license. After analyzing all of the evidence, I noticed several weaknesses with the prosecutor's case, including the lack of reasonable suspici ... on to stop the vehicle since it was parked in a parking lot, and my client was not in the driver's seat. In addition, the prosecution would have had a serious challenge proving that my client was actually impaired while driving, if in fact he was driving at all.
