Our juvenile client was arrested for visiting a common nuisance, possession of marijuana, and criminal trespass. After speaking with the client, we realized she did not commit any actual crimes: she di ... d not know she was at a “common” nuisance, did not possess any marijuana, and did not know she did not have permission to be on the property where she was arrested. The client was offered an informal adjustment, which would have required her to admit guilt. We fought the allegations and negotiated with the prosecutor. Ultimately, no charges were filed.

Felony Possession of Cocaine & Misdemeanor Public Intoxication in Allen County

OUTCOME: Possession of cocaine charge dismissed. Plea of guilty for public intoxication charge that allowed the client to remain in the United States.

Our client failed to appear for an Initial Hearing in June 2008 due to a language barrier, at which time a warrant was issued for his arrest. After visiting Indiana, he returned home to Iowa and forgot ... about the case. In 2015, while trying to obtain legal status in the United States, he discovered the outstanding warrant. The client turned himself in and was held without bond. After being retained, we negotiated for a time-served plea to the public intoxication charge. The felony possession charge was dismissed. As a cocaine conviction would have deemed our client inadmissible to the United States, the plea allowed him to pursue gaining legal status and avoid possible deportation.

OUTCOME: Client's 14 criminal cases were expunged and he obtained specialized driving privileges.

Our client had 14 fourteen criminal cases in Tippecanoe County, ranging from 1988 to 2005. The cases included dismissed cases as well as convictions for misdemeanors and felonies. After ongoing back an ... d forth with the prosecutor’s office, all criminal history was successfully expunged. The client also had a lifetime suspension on his drivers license. We were able to obtain specialized driving privileges.
