In this case, Eula McLaury sued her own nephew over a tiny home he built for her in his own back yard at her request and to her specification. Ms. McLaury was quite advanced in age and died during the ... course of the trial. Two of her three sons continued the action after her death. They were suing either to take the tiny home from the nephew defendant or for its cash value, roughly $50,000. I represented the defendant nephew and we counter-sued Ms. McLaury for breaking her deal with him. In short, the evidence was quite convincing that there was an oral contract between them, and that (1) Ms. McLaury would pay up to $50,000 for the tiny home, (2) Nephew McLaury would build it, and (3) Nephew McLaury was to retain the tiny home when she was done with it. The jury returned a verdict allowing my client, the nephew, to keep the tiny home he built with his own hands for his grandmother.
