Client retained legal services for their contested divorce action, which involved significant contentious divorce issues with their estranged spouse. The issues included but were not limited to, child ... custody, child support, division of marital assets such as real property (home and condominium), spousal support and maintenance, attorney fees and pension/retirement assets. Such case was severely contested and required the resolution of all of the most important divorce/matrimonial related issues. The case was decided in the Supreme Court of New York and required lengthy and complicated deliberation.

OUTCOME: Client was awarded final Order of child support for BOTH children, overcoming the opposition's claim of low income.

Client sought child support on behalf of their two children, out-of-wedlock. The parties were not married, but shared mutual and biological children their relationship. Moreover, one of the children wa ... s subject to paternity proceedings stemming from the father's objection that the child was his. Following the paternity proceedings, and highly contested child support deliberations, the case was resolved after a fact-finding hearing (trial) on the facts of the matter. One of the main issues faced in this matter was the opposing party's claim of insufficient income earnings. Following the resolution of trial, income was imputed upon the opposing party, their corporate earnings were also taken into account, and a final award of child support was ultimately rendered by the Court.

Child Custody Proceeding - New York Family Court

OUTCOME: Client was awarded final and SOLE custody of the parties' children, together with a final award of child support, and resulted in the Client obtaining the final legal right to make all major decision-making as related to the parties' children.

Client was engaged in a highly contentious legal battle for sole custody of the parties' two children. Client's estranged spouse opposed their application aggressively in order to attain their own awar ... d of sole custody of the children. The parties' children were assigned an attorney in order to protect their own legal interests and rights. Moreover, forensic evaluation was Court ordered, requiring the professional mental evaluation of all parties involved - prior to advancing further Court proceedings. Notwithstanding, and following the conclusion of all of the foregoing professionally assigned analyses, the parties were still unable to reach a mutual global settlement of their differences in the action. Accordingly, the highly contested issues of this matter - aggressively litigated by both parties - ultimately necessitated a full and complete trial on all outstanding issues in this Family Court custody action. As expected, the ensuing litigation necessary to reach a resolution in this matter was extensive, complex and significantly litigious in its entirety.
