Client was arrested for domestic violence. The State of Georgia charged him on a 9 count accusation of charges ranging from multiple counts of battery, simple battery, simple assault, and disorderly c ... onduct (all under the Family Violence Act). The state presented evidence at trial from the victim, a domestic violence expert witness, two officers, and 3 other independent witnesses. I presented evidence that showed inconsistencies with the victims story, the alleged crime scene, and the victims motivation to use the criminal proceedings as leverage in the custody battle that was ongoing. The case was tried before jury.

Client was encountered by law enforcement due to a BOLO being called out regarding his car. The license plate number came back to his residence. Client made it home and had sat down to have a drink. ... When officer's knocked on his door, he invited them in. They asked if he could step outside where they performed field sobriety tests and subsequently arrested him for DUI. He blew well over the limit back at the detention center. Motions were argued regarding, custody, probable cause, and articulable suspicion to encounter my client.

Officer saw my client speeding on GA 400. Pulled out to get behind my client; however, the officer testified that my client sped up and used evasive maneuvers to escape sight of the officer. My clien ... t pulled down a dark dirt road of a house that belonged to a friend of his at 2 in the morning. The officer saw the tail lights of my clients vehicle and pulled down to encounter him. Upon first contact, the officer noted a strong odor of alcoholic beverage and asked if my client would submit to field sobriety evaluations. After much discussion, my client refused. He was placed in the back of the police car where he became fairly abrasive and belligerent to the arresting officer. My client asked to have a trial by a jury of his peers.
