The best thing to do would be to hire an attorney. Technically, you would have had a duty to notify the court of the move prior to it occurring.

The child's wishes do not necessarily govern the decision. It is a factor the court can consider though.

Typically if you have to go back, it is because the dismissal is not yet processed. Some prosecutors will not dismiss unless you show up for that...
