Self-Defense Act helps overcharged client.
Sep 07, 2017OUTCOME: All charges dismissed.
A client, with no previous criminal history, was charged with felonious assault and felony firearm--two very potentially devastating, life-altering charges based on a situation that occurred outside hi ... s home. We argued that Michigan's self-defense act, passed in 2006, gave the client immunity from prosecution. And for the case to continue, the prosecutor had to prove he was not compliant with this law. The court agreed with us and found the prosecutor failed to meet its burden. The charges were dismissed, but the prosecutor appealed. We were affirmed and the case stayed dismissed.
