In December of 2014, the 38 year-old female plaintiff slipped and fell in a parking lot while picking up her infant child from daycare in Natick, Massachusetts. The accident occurred at approximately ... 5:00pm, as the plaintiff was returning to her car with her young child. The plaintiff’s child had been attending the daycare for approximately three months and the plaintiff consistently picked her up at the same time. In the days leading up to the fall, a combination of snow and rain had fallen and the temperature fluctuated above freezing. On the day of the plaintiff’s accident, the temperature dropped below freezing. The owner of property had previously entered into an agreement with a snow removal company to monitor the weather and provide de-icing services whenever the temperature was close to or below 32 degrees, however it was learned in discovery that no formal contract existed. Additionally, at the time of the accident, the property owner was delayed in repairing a parking lot light near where the plaintiff’s vehicle was parked. Photos of the parking lot demonstrated that the asphalt was uneven and poorly maintained which allowed water to pool. Discovery revealed that the snow removal company appeared the following morning to provide de-icing services. The defendants maintained that the plaintiff was comparatively negligent and that the parking lot was not slippery or unreasonably dangerous. In support of their contention they site the fact that only moments before the accident, the plaintiff was able to walk across the parking lot into the daycare center without any difficulty whatsoever. As a result of her fall, the plaintiff suffered a tri-malleolar fracture to her right ankle and underwent open reduction internal fixation surgery. While the surgery was largely successful, the plaintiff continued to suffer from ongoing limited range of motion in her right ankle. The case was settled at mediation.
