5th offense cases are difficult for a number of reasons. First, the driver is on a .02 standard due to having 4 prior OWIs. Second, Judges and DAs are hesitant to give the client the benefit of the dou ... bt. In this case, the client did an incredible amount of work to prove to the prosecution and judge that he had turned a page on his drinking days and was committed to sobriety. Facing a minimum sentence of 180 days jail and a maximum sentence of 10 years prison, we fought hard for a probationary sentence with conditional jail time. The Judge rewarded the client for his hard work and sentenced him to 5 years probation and 270 days in the local jail.
