5th offense cases are difficult for a number of reasons. First, the driver is on a .02 standard due to having 4 prior OWIs. Second, Judges and DAs are hesitant to give the client the benefit of the dou ... bt. In this case, the client did an incredible amount of work to prove to the prosecution and judge that he had turned a page on his drinking days and was committed to sobriety. Facing a minimum sentence of 180 days jail and a maximum sentence of 10 years prison, we fought hard for a probationary sentence with conditional jail time. The Judge rewarded the client for his hard work and sentenced him to 5 years probation and 270 days in the local jail.

Through the client's efforts and assistance to law enforcement, the district attorney's office in the arresting county declined to prosecute the client. The client learned from the mistake and dedicated himself to living his life as a law-abiding citizen.

Atty. Skarie obtained a great result for the client in this case. Client was arrested for a second offense OWI with a reported blood alcohol concentration of .22 g/100mL of blood. Obviously, a high BAC ... . Fortunately for the client we were able to obtain a copy of the dash cam video recording during law enforcement’s road side investigation. During their road side investigation officers have subjects perform Standardized Field Sobriety Tests. In this case, we quickly identified a number of errors that law enforcement made in administering and scoring the tests. With the client’s approval, Atty. Skarie filed a motion to suppress evidence alleging that law enforcement did not have the requisite level of probable cause to arrest the client. After a contested hearing, with the cop making many admissions on the stand as to his improper administration of the SFSTs, the Judge agreed with us and granted our motion to suppress the evidence. Without the necessary evidence to proceed forward at trial, the prosecution voluntarily dismissed the case. Fantastic result and a very happy client.
