Client was a passenger in a car that smelled like marijuana and contained on the floor of the back seat 2 ounces of marijuana packaged in smaller individual baggies along with a digital scale. Further ... more, Client had an excessive amount of cash in his pocket that was in denominations of $20s. All of the evidence was indicative of marijuana distribution. However, there was no evidence that my client was "knowingly or intentionally" in possession of the marijuana and digital scale. As a result, the charge was dismissed and my client walked out of the courthouse not guilty.
OUTCOME: Providing Alcohol to Minors charge: NOT GUILTY
Client hosted a 2-room hotel party and had several guests under the age of 21 that were caught with alcohol. At trial, the evidence proved that my client "gave, provided, or assisted" his underage gues ... ts in obtaining alcohol. However, the police officer made a clerical mistake and accidentally charged my client under the wrong law. As a result of this technicality, the judge found my client not guilty.
OUTCOME: DUI charge: NOT GUILTY
Client was in an accident and flipped his car over. The police responded and found spilled alcohol inside of the car. At trial, the evidence proved that: (i) my client smelled like alcohol because the ... accident caused the alcohol container in his car to open and spill all over my client; (ii) my client did "pretty good" on the field sobriety tests; (iii) my client had confessed to having his last drink hours before the accident; and (iv) the police officer admitted that he was not watching my client during the 20 minute observation period that precedes the breath test at the jail, which means that my client could have put his hands in his mouth or burped during the 20 minute observation period and thus registered a falsely high BAC on the breath test machine. As a result, the judge found my client not guilty.
OUTCOME: Malicious Wounding charge: REDUCED TO UNLAWFUL WOUNDING
Client was charged with Malicious Wounding due to stomping the victim on the head 12-15 times while the victim was lying on the ground. The victim was hospitalized due to head injuries. After a 6 hour ... trial, the evidence proved that my client reacted to the victim in self-defense, but was excessive in using self-defense. However, because my client acted in self-defense, he did not attack the victim with "malice" (i.e., an evil will). As a result, the charge was reduced to Unlawful Wounding.
