Mr. Alberga hired a General Contractor to do some work on his home. J Home Construction Services was a sub-contractor who was not paid out of the funds paid to the General Contractor. A lien was filed ... against the house preventing Mr. Alberga from refinancing his home. This case was a quiet tile action based on a legal demand made that the J Home either go to court to enforce the lien, or release it. Because J Home did neither of the required actions the court granted a release of the lien and issued a quite title.
