Motion to withdraw Guilty Plea because not Advised of Immigration Consequences
Nov 20, 2015OUTCOME: Prevented client from being deported and became a US Citizen
My client was convicted in 2006 of a misdemeanor domestic violence. When he pled guilty he was US Permanent Resident. Prior to pleading guilty he was not advised of the potential immigration consequenc ... es of his plea, including being denied US citizenship and being deported. In 2015, my client applied to be a US Citizen. He was denied and placed in deportation proceedings because of his 2006 misdemeanor DV conviction. Subsequently he retained me. I then filed a motion to withdraw his plea because he was not advised of the potential immigration consequences of his plea. Over the Prosecutor's objection, I won my motion. My client's plea was withdrawn. He avoided being deported and became a US Citizen.
