This particular case was very interesting in that both parties had prior counsel who achieved nothing for the parties over the course of a year and a half. The other side wanted to proceed in a content ... ious manner after being misinformed about the possible outcome of the case. My client had realistic goals and had a reasonable settlement offer in place. After putting forth the settlement offer before the other side and including WITHIN the offer the realistic outcome of proceeding with litigation, the other side realized the offer was highly reasonable. After a year and a half of no resolution, the parties entered into a stipulated judgment within only weeks of our office being retained.

OUTCOME: Emergency jurisdiction was granted to client and the minor was protected!

Client needed California to take emergency jurisdiction over the minor. The case was registered in Oregon but no parties resided in Oregon. One parent lived in another state and client resided in Calif ... ornia. Initially, utilizing the UCCJEA I petitioned to have a local court take jurisdiction. The local court did not feel it had jurisdiction. I then went in ex parte in a different County requesting the Court to take emergency jurisdiction under the UCCJEA.

OUTCOME: Client's interest were protected by negotiating a MSA.

This case involved a long term marriage, no children, and limited assets. The case was highly contentious due to the emotions of each party which resulted in a desire to litigate. Utilizing mediation s ... kills, I was able to get the parties to sit down and discuss their case. After presenting to my client the pros and cons of moving forward to litigate non-issues and the money that would be saved by resolving the case outside of Court the parties reached a marital settlement agreement. My client's interests were best served by such as there was a dispute as to spousal support. A court order would have been detrimental to my client. The MSA was most advantageous and the client was very happy with the resolution.
