Client was made subject to section 212(e) based on government financing as a result of a scholarship funded by a private foreign corporation, which was managed by a U.S. J-1 sponsor that was financed b ... y the U.S. government. We were able to obtain an Advisory Opinion confirming that 212(e) did not apply to our client by presenting evidence that the source of the client's scholarship was not the foreign government and that the U.S. agency managing the program was not the sponsor of the applicant's program, and thus that organizations designation as a U.S. government financed institution was not applicable.
