This matter arose from an injury sustained by Plaintiff on a hay wagon ride at a private Halloween party thrown by the Defendants. The wagon was maintained by the Defendants on the Defendants' property.... The day before the party, the Defendants were aware that there was cracking and rotting in the wooden planks that made up the floor of the wagon. Defendants made repairs to the visible cracks with some ply wood and then covered the wagon bed with hay. On the date of the incident, the wooden planks of the wagon snapped like match sticks, and Plaintiff fell through the wagon, landing beneath it. The wagon, being driven by Defendant Randall Morrow, continued to roll forward, and Plaintiff's left leg was crushed under the wheel. Plaintiff's position was that this was an inexcusably preventable injury that was caused entirely by Defendants' negligence. Defendants' position was that this was an unpreventable freak accident.
While Plaintiff, fortunately, did not sustain any broken bones, she did suffer a large hematoma in her left leg. The hematoma calcified, resulting in deep vein thrombosis. The deep vein thrombosis became complex regional pain syndrome type 1 ("CRPS"). CRPS is a permanent, incurable condition causing persistent, unremitting, demoralizing pain. Plaintiff's CRPS diagnosis was confirmed by defense medical expert, Leonard Sahn, M.D. Plaintiff's pain psychiatry expert, Dr. Gerald Shiener, opined that Plaintiff's symptomatology "portends a poor prognosis for further recovery" and that she would require "a comprehensive program of supportive psychotherapy, aggressive treatment with antidepressant medication, and pain management administered by the collaboration of specialists in Physical Medicine & Rehabilitation, Anesthesiology, and Psychiatry."
While Plaintiff was unemployed at the time of her injury, due to her chronic, unrelenting pain from her CRPS, as well as her post-traumatic stress disorder, Plaintiff's experts, Dr. Ronald Smolarski and Dr. Gerald Shiener, opined that Plaintiff was unable to work or find gainful employment. Dr. Sahn disagreed that Plaintiff could not work due to her injuries.
Ultimately, the matter resolved after the combined efforts of a facilitation with Ed Souweidane and settlement conference with Hon. Judge Kathryn Viviano.

Third-party auto negligence matter involving a severe rear-end crash, causing injury to my client. Defendants' insurer, Encompass, dragged out the litigation process for nearly two years. Despite reaso...nable attempts to resolve this case without a trial, Encompass not only forced my client into trial, they also placed their insureds in the line of fire and exposed them to an excess judgment.
Despite all the medical evidence and testimony, Encompass' final and only settlement offer was $2,500.00.
The case was tried before a jury of 6. The trial took 2 days.
