Manno Joseph v. Department of Correction
Jan 01, 2017OUTCOME:
Haitain immigrant convicted via a plea deal of risk of injury to a minor in connection with a sex act on an underage minor. The defendant, as a result of the conviction, was deported. He filed a peti ... tion for writ of habeas corpus alleging that his counsel was ineffective, as counsel failed to advise him that there would be mandatory deportation as a result of the conviction. The testimony was clear that the lawyer did not so advise his client. The court, however, denied the writ for habeas corpus on the grounds that he could not show he would have taken the case to trial even knowing he would be deported, given the strength of the state's case and the likelihood of conviction after a trial. http://www.theday.com/article/20170327/NWS04/170329351
