OUTCOME: Protection of a child
We are completing an estate plan in which the clients do not think their only child responsible enough to handle money following the death of the survivor of the clients. We simply created a trust int ... o which we placed the client's money and property permitting both spouses to use their assets as they wished during their lifetimes. But instead of their estate being paid outright upon the survivor's death, the trust terms require that friends of the clients act as trustees to oversee the distribution of funds until the adult child is mature enough to make responsible financial decisions.
OUTCOME: We were able to have a court appointed attorney hold funds for the minor children
Unfortunately a divorced mother left her large estate to minor children. Ordinarily this would leave the former husband in charge of the minors' funds.
OUTCOME: We prevailed. The other daughter withdrew her petition.
Our firm represented the child who had power-of-attorney over her mother's estate and was appropriately handling the finances. The mother suffered from Alzheimer's. Another child attempted to overthrow ... the arrangement and have herself appointed guardian and an attorney appointed as conservator.
