Navient Fired Exec Without Cause After Buying Company, Jury Says

OUTCOME:

(October 31, 2022, 4:50 PM EDT) -- A California federal jury determined Monday that Navient Corp. didn't have cause to fire the co-founder and CEO of a fintech startup the student loan giant acquired ... for $155 million, entitling him to additional compensation that a judge will determine in a second phase of the trial. The jury deliberated for less than two hours before reaching its decision in the breach-of-contract suit brought by Earnest co-founder Louis Beryl, who was ousted from the company he founded just three months after inking a deal with Navient to remain on board as CEO. Beryl is seeking over $4.4 million from Navient, including unpaid severance and promised stock and performance awards. The jury was not asked to determine the total damages owed to Beryl, which will be determined later by the judge. As part of the verdict, however, the jury found that Beryl is entitled to $1 million in restricted stock and $1.4 million in performance awards. The jury also found that Navient had agreed to boost Beryl's annual base salary from $300,000.00 to $400,000.00 and to increase his bonus from 75% of his annual base salary to 100%.
