Termination of Deportation Proceedings following a PCRA

Client was a Lawful Permanent Resident from the Dominican Republic who had been in the country for several years. The Client pled guilty to PA Fraud statute with a loss of more than $10,000. Almost a ... year later, the Client was apprehended at his resident by Immigration Customs and Enforcement (ICE) for this conviction. Our firm filed a PCRA based on Padilla v. Commonwealth of Kentucky, 559 U.S. 356 (2010), for ineffective assistance of counsel. We argued that our client was not properly advised of the immigration consequences of pleading to the PA Fraud charge. The Criminal Judge granted the PCRA and reopened the case. After our successful PCRA, I represented the Client in his immigration proceedings. I was able to aggressively advocate for my client and get the immigration proceedings terminated.
