Following two years of appeals, the Virginia Supreme Court ultimately found that trial error was committed and the case was reversed and remanded for a new trial on all counts.

Commonwealth of Virginia v. Spierto

OUTCOME: all charges dropped

After being stopped for expired tags, Mr. Spierto's car, as well as his person, were searched. Marijuana was found and Mr. Spierto was charged with a possession offense. The case was not resolved ... by agreement, and moved forward to trial. At trial, we moved to suppress the evidence because it was illegally obtained. After extensive argument, the Judge agreed with our position and suppressed the evidence. Mr. Spierto's charge was then dismissed.
