Chapter 7 bankuptcy is the type in which a debtor can discharge most debts without having to repay them. In this way a debtor can obtain immediate relief from creditors who are constantly calling and sending letters. It will also halt any lawsuits or garnishments. Many consumers have been adversely effected by these uncertain economic times, which have placed them in financial distress. A Chapter 7 filing can provide many debtors with the "fresh start" they need.

Chapter 13 is the type of bankruptcy filing in which the debts are repaid in full or in part over a three to five year time period. In the meantime all creditors will be barred from proceeding with any foreclosures or other lawsuits, or even contacting debtors. This filing would be needed to prevent a foreclosure of a home or restructing of an auto debt, or may be required where a debtor is over median income. Once the plan was completed, debtors would get their "fresh start".
