You can extend your H-1b beyond the 6 years if your labor cert/ PERM was filed one year before your 6 year ends ..

You can file a writ of habeas corpus to have him released, but I assure you ICE will pick him up the moment it is filed

No, you must wait until I-129 is filed. Many attorney say wait until receipt is issued, but that is not required under AC21
