you r status will change to H-1b on Oct 1 assuming your new employer filed for change of status

I suggest hiring a lawyer to see your options. It may be easier to file with your mother as long as she is still with your step...

Technically you can, but you may have trouble convincing the officer you will be returning home to use the K-1 visa
