Nov 03, 2017OUTCOME: After a four day trial to the court, the court entered judgment against Adams County in favor of Kimminau (our client) for $177,729.16. Total judgment and settlement against all defendants was $211,216.06.
This case involved a serious injury to our client, Kimminau, resulting from a rollover accident in rural Adams County, Nebraska. The rollover was caused by corn mash which was left on the road after a ... spill the day prior. The City of Hastings, Adams County and the Rural Fire District were found by the Nebraska Supreme Court to have left the roadway in a defective condition after attempting to clean up the roadway after the spill. The case ultimately went to trial against Adams County, after reaching a settlement with the City of Hastings and the Rural Fire District, and the trial court entered a judgment against Adams County in favor of Kimminau.
